Illinois DUI law under 625 ILCS 5/11-501 makes driving with a BAC of 0.08 or higher a criminal offense. A first conviction is a Class A misdemeanor with a one-year license revocation. A second conviction requires mandatory jail or community service and a five-year revocation. By the third offense, the charge becomes a Class 2 felony. Requests for arrest reports from those agencies go directly to those departments using Illinois FOIA procedures under 5 ILCS 140. Agencies must respond within 5 business days, and arrest reports must be released within 72 hours of a proper request.
