Morgan County Sheriff and FOIA Records

The Morgan County Sheriff's Office handles DUI arrests in unincorporated areas of the county and maintains arrest records for those stops. These include the arrest report, booking information, and any field sobriety test documentation. The Illinois Freedom of Information Act gives you the right to request these records in writing from the Sheriff's Office records division.

The Sheriff handles the arrest side of the record. Court records are separate and held by the Circuit Clerk. To get the complete picture of a DUI case, from the initial stop to the final court outcome, you need to contact both offices. Each request must be made independently because they do not automatically share records.

Illinois DUI Law: Charges, Suspensions, and Record Impact

Illinois DUI law under 625 ILCS 5/11-501 sets a 0.08 blood alcohol limit. Drive at or above that level, or while impaired by any substance, and you can be charged with DUI. The first offense is a Class A misdemeanor. The second is also a misdemeanor but with more consequences. The third DUI is a Class 4 felony. Each additional conviction can be charged as a Class 2 felony.

A Statutory Summary Suspension under 625 ILCS 5/11-501.1 kicks in right after a DUI arrest. Refusing a chemical test means a 12-month suspension. Failing the test means 6 months. The driver has 90 days to petition the circuit court to rescind the suspension. If no challenge is made, or if it fails, the suspension takes effect and shows on the SOS driving record as a separate line from any criminal conviction.

License revocation is mandatory after a DUI conviction under 625 ILCS 5/6-205. Getting the license back requires a formal petition to the Secretary of State. And unlike many other types of criminal records, DUI convictions in Illinois cannot be expunged or sealed under 20 ILCS 2630/5.2. The record is permanent. This affects anyone who has a DUI conviction in Morgan County or anywhere else in Illinois, no matter how long ago it happened.

ISP Criminal History and CHIRP System

The Illinois State Police Bureau of Identification maintains a statewide criminal history database that includes DUI convictions from all Illinois counties. To check your own record, use the ISP My Record portal at isp.illinois.gov/BureauOfIdentification/MyRecord. This lets you view and print your own Illinois criminal history report without going through a third party.

Courts, attorneys, and authorized agencies use the CHIRP system (Criminal History Information Response Process) to pull official ISP records. The ISP Bureau of Identification phone number is 815-740-5160. Their main information page is at isp.illinois.gov/BureauOfIdentification, and criminal history-specific information is at isp.illinois.gov/BureauOfIdentification/CriminalHistory. Because DUI convictions cannot be sealed, they stay in this database indefinitely.

Secretary of State Driving Records

The Illinois Secretary of State keeps a driving abstract for every licensed Illinois driver. This record shows license status, any suspensions or revocations, and the driver's full DUI-related driving history. A standard driving abstract costs $20 and can be ordered online at ilsos.gov. It is separate from the ISP criminal record but complements it when you need a full view of a driver's history.

For Morgan County drivers whose licenses were revoked after a DUI conviction, reinstatement goes through the Secretary of State Office of Administrative Hearings. That process is detailed at ilsos.gov/departments/administrative-hearings.html. For license status questions or to find out where a hearing might be scheduled, the SOS Driver Analysis Section can be reached at 217-782-2720.

DUI Evaluations in Morgan County

Illinois requires a DUI evaluation before a revoked driver can seek license reinstatement. A licensed evaluator conducts a risk assessment and places the driver in a category that determines what treatment or education must be completed. The evaluation report is a required part of the SOS reinstatement hearing process.

Licensed evaluators in the Jacksonville area can be found through the Illinois Department of Human Services or through referrals from the Circuit Clerk's office or your attorney. Courts in the 7th Judicial Circuit may also require an evaluation as a condition of sentencing before a case is closed. Talk to your attorney or contact the Morgan County courthouse for details on how this process works in your specific situation.
